Agenda Item Summary:
The Western Pennington Flood Management District was formed by Pennington County and Rapid City in 1991; the City of Box Elder joined a few years later. State law permits these districts to fund and complete drainage projects within their boundaries, which extended from the Cheyenne through the county (excluding non-member cities). The oversight body for the district was the Western Pennington Flood Management Commission, which consists of three members from each member (two members of the governing body and one citizen). It appears that the district performed several drainage projects in the 1990s; however, around 2000, the commission stopped meeting with the consent of its members. The district was never officially dissolved according to the process in its governing documents and state law. Staff from the City, Pennington County, and the City of Box Elder met last month to discuss the process of formally dissolving the district and disposing of two properties owned by the commission. We are asking you to appoint two Council members and one citizen to the commission, so that it can meet one last time to complete its business and legally dissolve. Brandon Quiett is a Project Engineer with the Public Works Department who works with the City’s stormwater utility and is familiar with the property owned by the Drainage Commission.
