Agenda Item Summary:
In 2011 an agreement was entered into between the City and Hog Wild, LLC to allow the construction of a public water main to be deferred. Per Section 4 of the agreement “When said construction has been completed and accepted by the City, the parties will promptly execute and file a Discharge of Covenant which fully released the aforesaid real property from the obligations hereunder.” The project was recently accepted by the City, indicating this work has been completed and Hog Wild, LLC has completed their obligations of the agreement. The discharge of Covenant Agreement releases the original agreement from the property owned by Hog Wild, LLC.
