Agenda Item Summary:
Jenner Equipment has requested water service at its property, located at 3200 N Deadwood Ave. In order to provide service, a water main will need to be constructed within Harley Drive and west along Tatanka Road. Hog Wild, LLC, entered into a covenant agreement in December of 2011 that allowed it to defer constructing a water main within Harley Drive, a required subdivision improvement at the time. Per the agreement, construction of the water main was deferred until such time as either the property was sold or the City determined the improvement was necessary. The water main in Harley Drive is necessary to provide water service to Jenner Equipment. If the Council determines the Harley Drive water main is necessary, Jenner Equipment would be required to construct the water main in Tatanka Road. The City would pay oversize costs (8” to 12”) according to the terms of the covenant agreement and City policy.
