Agenda Item Summary:
The applicant has submitted a Variance request to allow gravel and asphalt millings in lieu of hard surfacing, to increase the maximum fence height allowed in the front yard from 4 feet to 6 feet, and to reduce the minimum required landscaping from 246,900 points to 204,610 points on property generally located on E. Saint Charles Street west of the intersection of Cambell Street and E. Saint Charles Street. The subject property is comprised of 5.67 acres of land zoned Public District (P) and is currently void of structural development. The property is used by the Rapid City Streets Department to store materials, equipment, and snow during the winter months. The current use of the property will remain unchanged. Improvements to the property are being made as part of a project to extend City storm sewer from Cambell Street east along E. Saint Charles Street and north across the subject property to a drainage channel that will ultimately discharge to Rapid Creek. Improvements include raising the grade of the site, installing perimeter fencing, improving the driveway approach, and constructing water and sewer in preparation for a future building. Rapid City Municipal Code (RCMC) §17.50.270.G requires off-street parking and equipment or vehicle maneuvering areas to be paved per the Minimum Standards for Construction of Parking Lots, which requires either 4 inches of concrete, 4 inches of asphalt, or 2 inches of asphalt plus 4 inches of base course. Gravel and asphalt millings are not permitted as a hard-surfacing material for parking or circulation unless a Variance is obtained. The applicant is requesting to allow gravel and/or asphalt millings in lieu of pavement or concrete due to the use of the property as a storage lot with no defined traffic circulation or loading/unloading areas. Staff recommends that a dust palliative be applied annually as required by RCMC §17.50.270.G.4.RCMC §17.50.340.C.1 states that no fence over 4 feet in height may be erected in any front yard within the Public District. The applicant is proposing to install a 6-foot tall chain link fence surrounding the entire property, including the front yard abutting E. Saint Charles Street, to provide full site security. The east adjacent property has an existing 6-foot tall chain link located 8 feet from the property line along E. Saint Charles Street and the applicant is proposing to continue the established fence line matching the setback, height, and fence material to provide better security and maintain a cohesive aesthetic. Per RCMC §17.50.300, a minimum of 246,900 landscaping points are required for the current development of the property. The applicant is proposing to reduce the minimum required landscaping to 204,610 points citing that existing trees must be removed for the drainage improvements. Future development will require reassessment of the landscaping. Subsequently, Staff recommends that the landscaping reduction apply only to the current use of the property and future development must meet the landscaping requirements or obtain a separate Variance.
