Agenda Item Summary:
The applicant has submitted a Variance request to allow asphalt millings in lieu of hard surface for a storage yard and allow 80% lot coverage in lieu of 75% on the property generally located northwest of the intersection of E. Chicago Street and Riley Avenue. The subject property is comprised of 0.2 acre, or 8,775 square feet, and is zoned Light Industrial District (LI). The property is currently undeveloped. The applicant is proposing to develop the property as a contractor’s storage yard for construction equipment associated with a private construction company. A shipping container will be placed on the property for storage of construction materials. A 6-foot tall chain link fence will be installed surrounding the storage yard and the applicant has indicated the area will be locked when not in use and monitored by security cameras. Rapid City Municipal Code (RCMC) §17.50.270.G requires industrial off-street parking and equipment or vehicle maneuvering areas to be paved as set forth in the Minimum Standards for Construction of Parking Lots, June 16, 1980. The Minimum Standards for Construction of Parking Lots require either 4 inches of concrete, 4 inches of asphalt, or 2 inches of asphalt plus 4 inches of base course. Asphalt millings is not permitted as a hard surfacing material for parking or circulation unless a Variance is obtained. The applicant is requesting to allow the asphalt millings in lieu of asphalt or concrete due to the intended use of the property as a contractor’s storage yard where the construction equipment stored and circulated would damage hard surfacing over time. Staff is recommending that a dust palliative be applied annually to the asphalt millings as required by RCMC §17.50.270.G.4.Additionally, RCMC §17.22.040.F states that the maximum lot coverage allowed in the Light Industrial District is 75%, including parking and loading areas. The area of the property that is proposed to be developed is approximately 7,015 square feet in size. Therefore, the site improvements will cover 80% of the lot area. The property was platted in 1870 and is legal non-conforming with regard to lot size, as it does not meet the minimum 20,000-square-foot lot size requirement of the Light Industrial District. The applicant is proposing to leave an undeveloped area of approximately 1,760 square feet in the southwest corner of the property to provide for drainage, landscaping, and any necessary detention.
