The applicant has submitted a Conditional Use Permit to allow an oversized garage on the property located at 4870 Berry Pine Heights Drive in the Low Density Residential District 1 (LDR-1).The property is comprised of 1.65 acres and currently contains a single-family dwelling with 2,938 square feet of living space, a 575-square-foot attached garage, and a 4-foot by 10-foot shed (40 square feet). The applicant is proposing to build a 30-foot by 40-foot (1,200 square feet) detached garage to house vehicles and equipment. The garage will be set behind the home, sharing access from the existing driveway. The siding will be of a similar material and color to match the character of the existing home on the property. The detached garage will serve as a replacement for a shed which was located in the northeast corner of the property. This shed has been removed and the detached garage will be placed in that location. The existing home and proposed detached garage are located on separate parcels under the same ownership. Since the garage is an accessory use to the single-family residence, the applicant must enter into a Developmental Lot Agreement, which must be recorded prior to issuance of a Building Permit. Per Rapid City Municipal Code (RCMC) §17.04.315, the maximum cumulative allowable size of all private garages shall be 1,500 square feet or 30% of the size of the gross floor area of the dwelling unit(s), whichever is greater. With regard to the subject property, 1,500 square feet is greater than 30% of the gross floor area and, therefore, all structures dedicated to parking or storage on the property cannot exceed 1,500 square feet without the approval of a Conditional Use Permit in accordance with RCMC §17.10.030.N. The existing attached garage of 575 square feet, existing shed of 40 square feet and the proposed detached garage of 1,200 square feet together total 1,815 square feet, which exceeds the maximum allowable 1,500 square feet of cumulative garage space by 315 square feet.
