Agenda Item Summary:
The applicant has submitted a Conditional Use Permit to allow an oversized garage on the property located at 305 N. 39th Street in the Low Density Residential District 1 (LDR-1). The property is comprised of 3.74 acres and currently contains a structure that was formerly utilized as a Montessori school. The applicant is proposing to remove the existing structure and construct a new single-family dwelling with an attached garage and also a detached garage on the subject property. The new single-family dwelling will be 2,270 gross square feet with a 529-square-foot attached 2-stall garage. The proposed detached garage will measure 70 feet by 40 feet (2,800 square feet) in size and constructed with two 14-foot tall garage doors. The applicant has indicated the detached garage will be used for personal storage of vehicles, a camper, and a UTV/ATV. The proposed detached garage will be constructed to match the materials and color scheme of the new single-family dwelling and will not be used for commercial purposes or as a second residence. Per Rapid City Municipal Code (RCMC) §17.04.315, the building footprint of private garages, including any building, structure, or part of a main building that is dedicated to parking, storage, or a permitted accessory use, cannot exceed a cumulative size of 1,500 square feet or the footprint of the dwelling unit without the approval of a Conditional Use Permit in accordance with RCMC §17.10.030.N. The footprint of the dwelling unit is proposed to be approximately 1,135 square feet with a 529-square-foot attached garage for a total footprint of 1,664 square feet. The detached garage area of 2,800 square feet exceeds the maximum 1,500 square feet of cumulative garage space and also exceeds the footprint of the dwelling unit by 1,136 square feet. The applicant has indicated that the oversized garage is proposed to be 20 feet in height. RCMC §17.10.060 states that an accessory building in the LDR-1 District cannot exceed 15 feet in height. In conjunction with this Conditional Use Permit request the applicant is requesting a Variance (File #25VA002) to allow a detached garage with a maximum height of 20 feet in lieu of 15 feet.
