Agenda Item Summary:
The applicant has applied to revoke a Final Planned Development Overlay on the property currently addressed as 865 N. Valley Drive. The subject property consists of approximately 11.73 acres of undeveloped land and is located west of the terminus of N. Valley Drive. The applicant intends to create three lots on the property. The two western proposed lots will cumulatively be 7.278 acres in size and are intended to be developed for industrial use. The eastern proposed lot will be 4.442 acres in size and is intended to be developed for commercial use. The applicant has submitted Rezone requests in conjunction with this application (Files #25RZ015 and #25RZ016) to change the zoning district of the eastern proposed lot from Medium Density Residential District (MDR) to General Commercial District (GC) and to change the zoning district of western proposed lots from Medium Density Residential District to Light Industrial District (LI). On May 27, 2021, the Planning Commission approved an Initial Planned Development Overlay to allow a townhome apartment complex on the property (File #21PD021) and on February 22, 2024, the Planning Commission approved the Final Planned Development Overlay for this project (File #24PD003). The proposed townhome development did not come to fruition and on January 26, 2024, Ordinance No. 6595 became effective which eliminated the Planned Development Overlay requirement for multiple building apartment complexes. The property is accessed by N. Valley Drive which is classified as a Collector street on the City’s Major Street Plan. N. Valley Drive was recently constructed and is located within a 68-foot wide right-of-way and is constructed with 32-foot wide paved surface, water, sewer, curb, gutter, street light conduit, and a temporary turnaround at the terminus. N. Valley Drive is built to City design standards which justifies approval of the revocation. Revocation of the Final Development Overlay will require that the future development of the property complies with all applicable requirements of the Rapid City Municipal Code (RCMC), Infrastructure Design Criteria Manual, International Building Code, and International Fire Code.
