Agenda Item Summary:
The applicant has submitted a Major Amendment to a Planned Development Overlay application to allow on-sale liquor in conjunction with a restaurant on the property located at 525 Saint Joseph Street, Suite 1 in the Central Business District (CB). The property is comprised of 1.37 acres and is currently developed with a multi-story, mixed-use structure containing a hotel, conference space, retail space, apartment units, and a parking garage per Building Permit #CIBP23-1096. On April 21, 2022, the Planning Commission approved a Final Planned Development Overlay (File #22PD007) to allow the mixed-used development on the subject property. This development is currently known as the Block 5 Project. The applicant is proposing to serve mimosas in conjunction with the restaurant, a gourmet toast and juice bar to be known as “Toastique”. The restaurant hours of operation will be seven days per week from 7 a.m. to 5 p.m. The applicant has indicated that alcoholic beverages will only be served during hours of operation by trained staff and alcohol will be stored in a designated locked storage area. The applicant has submitted a site plan identifying a proposed sidewalk café. In 2012, the west 13 feet of right-of-way along Sixth Street adjacent to the property was vacated. In May 2023, the vacated right-of-way was dedicated as a Pedestrian Access Easement by the property owner. The easement allows for a sidewalk or other pedestrian way upon or across the property of the easement. However, the easement states, “The area which is the subject of this easement shall be kept free of all obstacles, including fences, shrubs, walls, or other items that obstruct the visibility or usefulness of the easement.” If the easement is vacated in the future, on-sale liquor will be permitted to be served on the outdoor patio if physical separation from the sidewalk is in place. If any part of the patio is located within the public right-of-way, a sidewalk café permit must be obtained.
