Agenda Item Summary:
The applicant has submitted a Major Amendment to a Planned Development Overlay to expand the on-sale liquor area for an existing restaurant located at 4831 5th Street. The subject property is zoned General Commercial District with a Planned Development Overlay and is developed with a strip mall and a small boutique building. The existing restaurant is named Ma Cualli and occupies the western suite of the strip mall. On October 27, 2022 the Planning Commission approved a Major Amendment a Planned Development Overlay (File #22PD045) to allow on-sale liquor in conjunction with this restaurant. This approval stipulated that any expansion of the on-sale liquor use requires a Major Amendment to the Planned Development Overlay. The applicant is proposing to add outdoor seating on the existing concrete patio located along the northwestern side of the building. The patio will contain seating for 40 patrons and will be semi-enclosed by a pergola and by glass panels along the perimeter. The applicant’s representative has indicated that the patio will not be heated and will operate seasonally. Ma Cualli is currently open from 11:00 a.m. to 10:00 p.m. Monday through Thursday and from 11:00 a.m. to 11:00 p.m. Friday through Sunday. The applicant intends to serve alcohol on the patio during these identified business hours which is an expansion of the on-sale liquor use and therefore requires this Major Amendment to the Planned Development Overlay. This application is to consider expanding the alcohol service to the proposed patio, the patio enclosure and additional seating are permitted by right in this zoning district.
