Agenda Item Summary:
Annexation petitions have been submitted by three property owners comprising a total of 1,248 acres, generally located between Ennen Drive and Radar Hill Road. The subject property is contiguous to the Rapid City municipal boundary and is currently used for agricultural and single-family residential uses. The majority of the subject property is located within the Rapid Valley Sanitary District boundary, except for a portion located in the NE1/4 of Section 1, T1N, R8E, BHM, Pennington County, South Dakota. The subject property is currently zoned Agriculture (AG) in Pennington County (PC), with the exception of an unplatted portion of the NW1/4 of Section 2, T1N, R8E, which is currently zoned Suburban Residential (SR) in Pennington County. Concurrent Rezone requests have been submitted to change the zoning designation of the subject property from No Use District to General Agricultural (GA) District, in line with the current property use (Files # 25RZ018, 25RZ019, & 25RZ020). Although the City’s Future Land Use Plan identifies the subject property as appropriate for Low Density Neighborhood (LDN) development, no change in use is proposed at this time. Should this property be subdivided and developed in the future, it would need to be rezoned in alignment with the Rapid City Comprehensive Plan. The Rapid City Major Street Plan shows future extensions of Twilight Drive and Anderson Road as proposed Minor Arterial roads through the subject property. There is a future extension of East Anamosa Street shown as a proposed Principal Arterial street along the northern boundary of the property. There are also several proposed Collector streets planned throughout the subject property. A future Community Activity Center is shown at the future intersection of Twilight Drive and Anderson Road. The subject property is located within the Rapid Valley Fire District. Once annexed, the property will be under the jurisdiction of the Rapid City Fire Department. The Rapid Valley Fire District holds outstanding debt that is certified with the City of Rapid City that would enable payment from the City to the Fire District upon annexation pursuant to SDCL 34-31A-35 and Section 3.20 of the Rapid City Municipal Code. The District has requested the City to reimburse the property’s share of outstanding debt in the amount of $1,998.31, in order to prevent the loss of revenue to the Fire District upon annexation. The City may choose to pay this reimbursement. If City Council chooses not to pay this reimbursement, the Fire District may choose to create a special debt district with Pennington County to continue to levy the property’s share of outstanding debt against the property. This proposed annexation is in alignment with the minimum requirements set forth in in South Dakota Codified Law and local ordinances and policies. Further, this annexation protects the water main and airport infrastructure investments of the City.
