Agenda Item Summary:
The applicant has submitted a Variance request to reduce the front yard setback from 25 feet to 14.68 feet for the property at 1900 Fox Road. The subject property is comprised of 8.46 acres and is zoned Office Commercial District (OC) with a Final Planned Development Overlay (#21PD023). An apartment complex is currently under construction on the property, which will result in 14 two-story apartment buildings with a total of 308 units, a community building, 12 garage structures, and an outdoor swimming pool. A number of the buildings have been constructed, including those along the Mount Rushmore Road service road and Fox Road.The Variance has been requested by South Dakota Department of Transportation (SDDOT) to account for right-of-way needs for construction projects on Mount Rushmore Road. SDDOT is constructing a full access intersection at Fox Road to Mount Rushmore Road in replacement of the Tablerock Road intersection. A portion of the service road will need to be reconstructed due to intersection spacing standards between the service road and Mount Rushmore Road. The Variance is requested in order to acquire right-of-way from the subject property to complete the project. The proposed project is in conjunction with the new Single Point Urban Interchange proposed at Catron Boulevard and Mount Rushmore Road. The improvements will improve traffic flow and safety along Mount Rushmore Road and will benefit the community as a whole.
