Agenda Item Summary:
The applicant has submitted a Major Amendment to a Conditional Use Permit to allow a child care center on the property located at 910 Sioux San Drive in the Medium Density Residential District (MDR). The property is comprised of 1.78 acres and currently contains a religious worship facility. In November 1977, a Conditional Use Permit was approved to allow an addition to an existing church. The applicant is now proposing to operate a child care facility from the basement of the existing structure, which requires a Major Amendment to the Conditional Use Permit. The use of the religious worship facility will continue on the main level. The applicant has indicated that care will be provided for a maximum of 30 children ranging in age from six weeks to six years. Based on State staffing ratios, the applicant has indicated three to four employees will be required. A separate outside entrance provides access to the proposed child care center separate from the use on the ground level and keypad security will be installed to provide safety of the children and staff during operating hours. The child care center will operate from 6:30 a.m. to 5:30 p.m. Monday thru Friday. The applicant has demonstrated that adequate indoor and outdoor play space is provided for the proposed child care center in accordance with Rapid City Municipal Code (RCMC) §17.50.150.C. Adequate parking is also provided on the subject property per RCMC §17.50.270.D. The applicant has submitted supporting documentation indicating that a fire suppression system, smoke detectors, and a fire alarm panel will be installed in the child care center area prior to commencing the use on the property. The applicant has also submitted an Emergency Preparedness Plan outlining safety procedures to be taken in the event of fire, flood, or law enforcement emergency. The applicant will be licensed by the State of South Dakota prior to operation of the proposed child care center and must meet any additional State requirements necessary to obtain and maintain such license.
