Agenda Item Summary:
The applicant has submitted a Conditional Use Permit to allow an oversized garage on the property located at 2707 Tomahawk Drive in the Low Density Residential District 1 (LDR-1). The property is comprised of 0.97 acres (approximately 42,254 square feet) and currently contains a single-family dwelling with an 840 square foot attached garage and a 10-foot by 16-foot shed. The applicant is proposing to construct a 24-foot by 40-foot (960 square feet) detached garage to house a personal golf simulator for the applicant’s recreational use. The applicant is proposing to construct the building as a garage so that if the golf simulator is removed the structure can be used as a standard residential garage. The applicant has indicated that the existing shed on the property will be removed and replaced with the detached garage. The proposed garage is not intended to be used for commercial purposes or as a second residence. Per Rapid City Municipal Code (RCMC) §17.04.315, the maximum cumulative allowable size of all private garages shall be 1,500 square feet or 30% of the size of the gross floor area of the dwelling unit(s), whichever is greater. With regard to the subject property, 1,500 square feet is greater than 30% of the gross floor area and, therefore, all structures dedicated to parking or storage on the property cannot exceed 1,500 square feet without the approval of a Conditional Use Permit in accordance with RCMC §17.10.030.N. The existing attached garage of 840 square feet and the proposed detached garage of 960 square feet together total 1,800 square feet, which exceeds the maximum allowable 1,500 square feet of cumulative garage space by 300 square feet.
