Agenda Item Summary:
The applicant has submitted a Rezoning request to change the zoning designation of the properties located at 3310 Deadwood Avenue N and 3150 Tatanka Road from Light Industrial District (LI) to General Commercial District (GC). This request involves two separate properties which together are comprised of 12.4 acres and are currently developed with one shop building and a fenced, paved parking lot. On June 9, 2005, an Initial and Final Planned Commercial Development (#05PD033) was approved to allow a vendor park on a portion of the subject properties. The properties currently contain a shop building, a graveled parking area, a paved parking area, and a vendor park area. The existing building and the west half of the graveled parking area is leased to a trucking company which uses the property to maintain and store their tractor trailer fleet. The east half of the graveled parking area is leased to a propane distributor who uses the property to store their trucks and storage tanks. The paved parking area is fenced and utilized as the vendor park. Black Hills Harley-Davidson has purchased the properties and plans to continue operating them in the same manner as they have been for several years. The applicant is requesting this rezone in order to transfer a beer license that the previous owner had obtained and utilized for the vendor park. Originally the applicant was requesting to rezone the entirety of both properties to GC District. However, further review and discussion of the existing uses determined that the leases to the trucking company and propane distributor are uses that are more suited to remain in the LI District, while the vendor park use is more aligned with the GC District. Staff recommends, with the applicant’s concurrence, the following amendment to the rezoning request: 1.The graveled area in the northern half of the property addressed as 3310 Deadwood Avenue N (Lot 1R Revised) retain its current zoning as LI District; and, 2.The paved area that is fenced for the vendor park be rezoned to GC District. This includes all of the property addressed as 3150 Tatanka Road (Lot 2R Revised) and a 3.614 acre portion of the property addressed as 3310 Deadwood Avenue N (Lot 1R Revised) as described by metes and bounds.
