The applicant has submitted a Major Amendment to a Planned Development Overlay to relocate a swimming pool on the property located at 5102 Shelby Avenue. The property is comprised of 4.24 acres and is zoned Office Commercial District with a Planned Development Overlay (File #22PD040). The subject property currently consists of a 121-unit apartment complex that is under construction via Building Permit #23-0572. The Final Planned Development Overlay (#22PD040) was originally approved to allow a 119-unit apartment on the subject property. However, the Building Permit (#23-0572) was issued for a 121-unit apartment. Sufficient parking and open space is provided for the 121-unit building. With this request, the applicant is proposing to construct a swimming pool. The proposed pool will be an amenity provided only to apartment tenants and their invited guests. Access to the pool will be through the apartment complex using an electronic key fob. Rapid City Municipal Code ยง17.50.320.B.2 states the pool, including the areas to be used by the bathers, shall not be closer than 50 feet to any property line. The applicant is requesting an Exception to reduce the required setback from 50 feet to 24 feet in order to construct the 16-foot by 40-foot outdoor pool surrounded by a pool deck. A 6-foot tall decorative metal fence will surround the pool deck to provide screening and security.
