Agenda Item Summary:
The applicant has submitted a Petition for Annexation for a 27.89-acre property generally located north of Old Folsom Road and south of Elk Vale Road, at 5420 Old Folsom Road. A portion of the operations of Forest Products Distributors, a full-service wholesale lumber company, is located on the subject property. The remaining area of operations is located on adjacent property that is already located within City limits. The subject property is developed with several structures used for processing lumber, warehousing, and storage. The primary purpose of this annexation request is for connection to City water to accommodate the fire suppression system for this business. The proposed annexation area is located within the City’s Urban Services Boundary and City water services are available to the property. City sewer services are not available at this time. The subject property is contiguous to the Rapid City municipal boundary, and is currently zoned Heavy Industrial in Pennington County (PC). The City’s Future Land Use Plan identifies this property as appropriate for heavy industrial use, which supports the associated Rezone request to change the zoning designation of the property from No Use District to Heavy Industrial District after annexation (File #24RZ021). Access is provided from Old Folsom Road, which is classified as a Principal Arterial street on the City’s Major Street Plan. The subject property is located within the Rapid Valley Fire District. Once annexed, the property will be under the jurisdiction of the Rapid City Fire Department. The Rapid Valley Fire District holds outstanding debt that is certified with the City of Rapid City that would enable payment from the City to the Fire District upon annexation pursuant to SDCL 34-31A-35 and Section 3.20 of the Rapid City Municipal Code. The District has requested the City to reimburse the property’s share of outstanding debt in the amount of $4,828.67 in order to prevent the loss of revenue to the Fire District upon annexation. The City may choose to pay this reimbursement. If City Council chooses not to pay this reimbursement, the Fire District may choose to create a special debt district with Pennington County to continue to levy the property’s share of outstanding debt against the property. This proposed annexation is in alignment with the minimum requirements set forth in in South Dakota Codified Law and local ordinances and policies.
