Agenda Item Summary:
The applicant has applied to revoke a portion of an Initial Planned Development Overlay. The revocation consists of ten townhome lots and dedicated right-of-way in the Moon Meadows Park Subdivision. The properties are zoned Medium Density Residential District with Planned Development Overlays, #05PD077 and #16PD008 and are currently void of structural development. The owners intend to develop the lots with townhomes and will comply with all applicable zoning requirements. As indicated above, on January 5, 2005, the Planning Commission approved an Initial Planned Development Overlay #05PD077 to allow a department and convenience store. The subject properties are located in the southeast corner of this 45.7-acre Planned Development boundary. A Final Planned Development Overlay was never submitted for this project. As indicated above, on March 10, 2016, the Planning Commission approved an Initial Planned Development Overlay #16PD008 to allow an apartment complex. The subject properties are located on the east side of this 9.04-acre Planned Development boundary. The area in question was omitted from the Final Planned Development Overlay for this project and therefore remains undeveloped. On August 26, 2022, a Final Plat #22PL088 was approved to subdivide the property into ten townhome lots. On October 27, 2022, the Planning Commission approved a Revocation of a portion of an Initial Planned Development Overlay #22PD046 for seven lots and dedicated right of way in the Moon Meadows Ridge Subdivision. These lots are located directly to the east of the ten lots
