Agenda Item Summary:
The applicant initially submitted a Variance application to reduce the minimum side yard setback from 12 feet to 8 feet for a new single-family residence proposed on the subject site. The property is zoned Medium Density Residential District and is currently void of structural development. On March 7, 2022, a demolition permit was issued for the 60-year-old one-story single-family residence and detached garage that previously occupied the property. The new residence is two stories or 22.5 feet in height and is 21.5 feet in width. The main floor of the dwelling is 940 square feet and the upper floor is 989 square feet in size. An attached covered porch of approximately 210 square feet is proposed at the rear of the dwelling. A detached garage of 528 square feet with an overhead door facing National Street is proposed at the rear of the property. In all residential districts, one-story dwellings require a minimum 8-foot side yard whereas a two-story dwelling requires a minimum 12-foot side yard. All other requirements of the Medium Density Residential District have been met. As per 17.50.070.C.1 of the Rapid City Municipal Code, the Director is authorized to grant deviations of up to 20% of any minimum or maximum zoning district standard, development standard, and area regulation including setbacks. The applicant intends to revise the plans to show a setback deviation of 20% or less, therefore, negating the need for a Variance.
