Agenda Item Summary:
The applicant has submitted an application for a Major Amendment to a Planned Development Overlay to revise a stipulation of File #21PD016, a Final Planned Development Overlay to allow an apartment complex. In particular, the applicant is requesting Stipulation 7 of the aforementioned project be removed. Stipulation 7 requires that, “Prior to issuance of a Certificate of Occupancy, a Major Amendment to the Planned Development shall be submitted for the proposed park identifying the play equipment and mature landscaping.” The aforementioned park space does not account for any of the required open space or landscaping for the apartments. All open space and landscaping requirements are met entirely on the subject property, Lot EF-REV of Johnson Ranch Subdivision. Stipulation 7 was included to ensure a time element existed for the construction of the community park. On June 9, 2022, an application for a Final Planned Development to allow a Community Park on Tract BR-1 of Johnson Ranch Subdivision including plans for mature landscaping and open greenspace was brought before the Planning Commission for review and approval. The item was continued to allow the applicant time to revise the proposed park plan to include the addition of amenities. However, on July 5, 2022, the City Council directed staff to facilitate the acquisition Tract BR-1 in addition to Lot 57R providing an additional 0.4 acres of land for a total 1.31 acre park. The Rapid City Parks and Recreation Department has agreed to provide amenities and maintain the property as a City park. Based on this action, the applicant is no longer responsible for the construction of the park. Subsequently, the applicant has withdrawn the Final Planned Development Application for the park (File #22PD015). On July 21, 2022, the applicant provided a copy of a signed quit-claim deed for Tract BR-1 and Lot 57R to be owned and maintained as public park land by the City of Rapid City.
