Agenda Item Summary:
The applicant has submitted a Major Amendment to a Planned Development Overlay to allow a cirque show as an extended temporary use on an annual basis. The cirque show will be held at the Uptown Rapid Mall. In particular, a 120-foot diameter by 39-foot tall circus style tent is proposed to be located in the south-east corner of the parking lot. The event will be held from June to August and the tent will be constructed at the end of April for practice runs and overall lighting and stage development. In total, the applicant is requesting 200 feet diameter of clearance for the tent and cables, support trailers, food trucks, and merchandise tables. Seating capacity for the tent is 1,500 people; however, will be limited to 600 during this first year of the event. The applicant has been producing shows in the area for the past five years and owns a business at the Uptown Rapid Mall called Live It Up Studio where local students are taught aerial dance and circus arts. The applicant’s most recent show was in December at the Monument, 1,500 were in attendance and included sponsorship of 10 other local businesses. The subject property is zoned Community Shopping Center-2 District with a Planned Development Overlay and temporary events pursuant to Chapter 17.50.230 of the Rapid City Municipal Code (RCMC) are a permitted use in this district with the approval of a Major Amendment to the Planned Development Overlay. The applicant is requesting an Exception to increase the minimum height requirement from 35 feet to 50 feet. The Uptown Rapid Mall is a Regional Activity Center with a Reinvestment Focus pursuant to the City’s Comprehensive Plan. The City’s Comprehensive Plan also recommends increasing activity levels around the Mall to support existing retail uses and spur reinvestment. The proposed Major Amendment to the Planned Development Overlay at Uptown Rapid is consistent with the City’s adopted Comprehensive Plan.
