Agenda Item Summary:
The applicant is requesting this Major Amendment to the Conditional Use Permit to allow an on-sale liquor establishment to operate in conjunction with a theater. In July of 2013, a Major Amendment to the Planned Development (File #13UR014) was approved to allow a theater and production company known as the Potter Family Theater to be located in the basement suite of the historic Buell Building. The approved Conditional Use Permit was specific to the Potter Family Theater as the operators of the theater and any change in operator required a Major Amendment. Today, a new production company known as West Dakota Improv is proposing to locate at the facility. Due to the change in operator, an amendment to the Conditional Use Permit is required. As such, the applicant has submitted this Major Amendment to the Conditional Use Permit. No additions, expansions, or alterations of the existing facility are being requested as a part of this Amendment.
