Agenda Item Summary:
Request: The City has received a request from several business and property owners along Mt. Rushmore Road to establish a new Business Improvement District (BID). For several years, this group has independently provided Christmas decorations along the corridor, funded through various grants. With those grant opportunities no longer available, the group has expressed a desire to continue and expand their efforts. In addition to continuing seasonal decorations, they hope to enhance landscaping and implement year-round security improvements along this key commercial corridor.

Citing the success of the Downtown Business Improvement District, the group is requesting that the City consider establishing a new BID in the Mt. Rushmore Road area. The initial step in this process is the appointment of a Board. Should the Council adopt the attached resolution, the Mayor’s appointments would be presented for confirmation to the Council. Once formed, the Board would be responsible for developing a formal plan and requesting that the City Council adopt a resolution of intent to establish the district. Following the passage of that resolution, the Council would hold a public hearing before deciding whether to proceed with the formal creation of the new BID. The group has indicated that the proposed district boundaries would not overlap with any existing Business Improvement District.

Proposed Board Composition: The Board would be composed of five (5) business or property owner representatives from within the proposed district. Members would be appointed by the Mayor, subject to approval by the Common Council. A property owner is defined as any of the following:

  1. An officer or director of a corporation that owns property;
  2. A manager or member of a limited liability company that owns property;
  3. A partner in a partnership that owns property; or
  4. A designated representative of a property owner, appointed in writing.
Terms of Appointment: Upon initial appointment, two (2) members would serve two-year terms, while the remaining three (3) would serve one-year terms.
