In January of 2021, you approved an agreement among the cities of Rapid City and Box Elder and Atlantis, LLC, which owns Watiki waterpark. That agreement related to the development of bare land adjacent to the waterpark. In conjunction with that agreement, a plat was approved creating a new lot on which an expansion to the waterpark was to be built. Additionally, as Rapid City was concerned about capacity issues related to serving the expansion with utilities, the new lot was de-annexed from Rapid City and annexed into Box Elder. The way the lot lines were drawn on the plat, there are approximately three feet between the wall of the current Watiki building and the lot line. The lot line also acts as the boundary between Rapid City and Box Elder. Since the expansion will be connected to the current building, there will be a small portion of the new building within the city limits of Rapid City. As such, a building permit would be needed for the 3 feet of the building within Rapid City, separate from the permit needed for the rest of the building in Box Elder. City staff doesn’t believe this is a necessary or practical use of city resources, nor does it serve the interests of the property owner, builder, or the public. State law allows units of local government to share or exchange work and property. With those considerations in mind, an agreement has been drafted with the City of Box Elder to put Box Elder in charge of all building permits and inspections for the building to be constructed.
