Agenda Item Summary:
During the 2021 legislative session, state law was changed to allow electric scooters on sidewalks throughout the state. This ordinance is to continue to ban all motor vehicles, including electric scooters from downtown sidewalks between the railroad tracks that run between Main and Omaha Streets on the north, St. Joe on the south, 5th Street on the east and 9th Street on the west. This ordinance also changes the code sections banning bicycles and skateboards from downtown sidewalks to make the area of the bans consistent. Law enforcement feels strongly that with sidewalk cafes, business signs, and foot traffic, it simply is not safe to allow motor vehicles on these sidewalks. The only exceptions are for motor vehicles used by persons with disabilities, law enforcement officers, and parking enforcement officers. This ordinance does not affect the use of scooters on sidewalks outside of this downtown area, once the new state law goes into effect on July 1.
