Agenda Item Summary:
Black Hills Energy Renewable Resources, LLC (“BHERR”) and The City of Rapid City desire to execute a Confidentiality and Nondisclosure Agreement (CNDA) in association with a Memorandum of Understanding (MOU), in order to collaborate together to evaluate the opportunity to implement a Renewable Natural Gas (“RNG”) project, whereby landfill gas and/or Wastewater Reclamation digester gas is proposed to be collected, processed into RNG, injected into the natural gas pipeline system, and sold into the renewable energy market. BHERR, a non-regulated subsidiary of Black Hills Corporation (“BHC”), has extensive experience in the RNG industry and seeks investment opportunities into RNG production assets located within BHC’s service territories and the City owns and operates a Regional Municipal Solid Waste (“MSW”) Landfill and a Water Reclamation Facility located outside the City in Pennington County. The City desires to provide new sources of revenue for the City and BHERR will fund an evaluation into the long-term feasibility of RNG for the City. A Memorandum of Understanding (MOU) accompanies this CNDA as a separate action item.
