Agenda Item Summary:
In 2008, the City entered into a Covenant Agreement between the City of Rapid City and with G and G Investments LLP for the Acquisition of a Permanent Utility Easement. The covenant agreement established a permanent utility easement on G and G’s property east of Elk Vale and north of Neel Street on which the City placed a water reservoir, as well as access to that property. The covenant obligated the property owner to plat the area encumbered by the utility easement into a platted lot at the time the property is developed and to deed the platted lot to the City, at no cost to the City. The property owner now wishes to sell the property, and as part of that sale is platting the easement area into a Reservoir Lot (similar to an h-lot) to be transferred to the City. This agenda item would permit the City to accept the Reservoir Lot deed and thereby accept the property as platted from G and G Investments LLP. Separate documents executed by the property owner will dedicate easements to the City for the existing water line to the reservoir as well as the access road between the reservoir and Elk Vale Road. The attached draft of the plat describes the lot as “Lot H2.” However, all parties agree that the plat as recorded will describe the parcel to be transferred as “Reservoir Lot.”
