Agenda Item Summary:
A request was received in the Engineering Office on June 13, 2018 requesting the requirement to install sidewalk along LaCrosse Street per City of Rapid City Ordinance 12.08.060 be waived. A five-foot wide sidewalk is required to be constructed along LaCrosse Street at the time of building permit, with the property having approximately 290 feet of frontage along LaCrosse Street The requested variance will allow for construction of an automobile dealership expansion on the property without the installation of sidewalk in the adjacent LaCrosse Street right-of-way. Adjacent LaCrosse Street is a four lane collector street with curb and gutter and void of sidewalk on the east side. Note that the applicant is also required to install sidewalk along East Omaha Street; the applicant is not requesting a variance to this sidewalk and is being installed as part of the project. On April 4, 2018 Public Works was contacted by the general contractor on the expansion project in regards to the LaCrosse Street sidewalk. There is a fire hydrant and telephone box located in the alignment of the proposed sidewalk location. Notes on the construction plans indicate that the contractor is to request the City fund the hydrant relocation and request that the utility relocate the telephone box. Public Works suggested as an option, to construct the sidewalk by going around the hydrant and box onto the applicant’s property for a short distance. This would require the applicant granting public access easements to the City but would avoid relocating the hydrant with a new hydrant, as it is City policy to not re-use fire hydrants. It would also avoid the relocation of the telephone box. On April 10th Public Works received a letter from the contractor stating it is the owner’s position the sidewalk will not be allowed on private property and the City shall grant a sidewalk variance. On April 30th Public Works responded with a letter indicating Staff could not support a sidewalk variance. There is one option for sidewalk; install five-foot wide sidewalk one foot inside the right-of-way. Public Works recommends denial of the sidewalk variance request. The Rapid City Council has the authority to order in sidewalk at any time.
