Agenda Item Summary:
In 1993, as part of the Park Drive project, Andrew J. Severson entered into an agreement with the City to be permitted to pay the assessment for his portion of the Park Drive costs when he plats the property. Unfortunately, some provisions in the 1993 agreement were unclear, including the total amount of the assessment, and as a result the City and Dr. Severson have engaged in several conversations over the past 3+ years about the assessment, the status of existing utilities on the property and an adjacent H-lot, and other matters related to development of the property. To clarify the outstanding issues, staff worked with Dr. Severson to draft the attached agreement which adds to the 1993 agreement and clarifies the obligations in the previous agreement. Dr. Severson is now ready to plat the property, which triggers the assessments that are due under the 1993 agreement and further clarified in this latest agreement.
