Agenda Item Summary:
A request was received in the Engineering Office on 2/22/2017 requesting the requirement to install sidewalk along Vista Hills Drive per City of Rapid City Ordinance 12.08.060 be waived. A 4’ property line or 5’ curb side sidewalk is required to be constructed along Vista Hills Drive at the time of building permit. Both Lots 12 and 13 of the E1/2NE1/4, Section 21, T1N, R7E are included was the property boundary, as shown on the attached map, thus the property has approximately 620’ of street frontage along Vista Hills Drive and 410’ of frontage along Sheridan Lake Road. The requested variance will allow for a garage expansion, of which is more than a 20% expansion, at a single family residence to be constructed without the installation of sidewalk in the adjacent right-of-way. Note that sidewalk is already installed along the street frontage of Sheridan Lake Road. Vista Hills Drive exists with no curb and gutter on the side of the road of the proposed garage, but does have curb and gutter on the opposite site of the road. Vista Hills Drive is a cul-de-sac street serving 8 single family residences, of which each lot is constructed with a single family home today and all lots void of sidewalk along Vista Hills Drive. With sidewalk constructed along this property’s frontage, a connected sidewalk corridor would be provided from the existing sidewalk in Sheridan Lake Road. However, further extension of a connected sidewalk corridor is unlikely unless the City Council should order in sidewalk for the street as future building permits are not anticipated. The property owner has indicated their willingness to construct sidewalks in the future. The nearest sidewalk is located in Sheridan Lake Road immediately adjacent to this property. Construction of a curb side sidewalk would be more practical than a property line sidewalk in this location, due to existing topography and vegetation. However, construction of a curb side sidewalk will require some significant grading work along with removal of some trees and be constructed like a shoulder to the road due to the lack of curb on this side of the road. The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary.
