Agenda Item Summary:
Applicant is attempting to re-plat existing Lot 2 of John Roberts Subdivision into two lots (Lot 2A and 2B). When Lot 2 was platted in 2013, subdivision regulations required dedication of an additional 17 feet of right of way along East St. Patrick Street. Because a building was located in a portion of the area that would be dedicated as right of way, the applicant and the City entered into a covenant agreement on July 1, 2013 where the applicant agreed to dedicate right of way on East St. Patrick Street in the future if the building was removed, the lot was further subdivided or developed, or the City needed the right of way. Now, the owner wants to further subdivide the Lot 2 into two lots and dedicate the needed right of way for Lot 2B but retain the building on Lot 2A. This covenant agreement would require future owners of Lot 2A to dedicate right of way along East St. Patrick Street if the building is removed, the lot is further developed or subdivided, or the dedication is needed because of corridor growth.
