Agenda Item Summary:
The applicant submitted a Preliminary Subdivision Plan for a proposed development south of East Mall Drive and East of Dyess Avenue on September 30, 2016. Sections 16.12 and 16.16 of the Rapid City Municipal Code require that the developer construct public improvements on Dyess Avenue south of East Mall Drive for approximately 700 feet, the length of platting. Dyess Avenue is a commercial street located in right-of-way of varying width with 24 feet of pavement but no curb, gutter, sidewalk, sewer or street light conduit. There is existing water main for just over one-half the proposed length of platting. The applicant submitted an Exception Request to Public Works to waive the requirement to construct public improvements on Dyess Avenue on October 21, 2016. The Exception Request was denied by Public Works on November 3, 2016; see attached denial letter. In denying the Exception Request, Public Works recommended the City partner with the developer of the proposed subdivision. The developer would be responsible for one-half of the cost to construct Dyess Avenue south of East Mall Drive, through the planned access approach to the proposed development, a distance of approximately 360 feet. Construction would include a paved surface, curb, gutter, sidewalk, sanitary sewer and street light conduit. Staff would then make a recommendation to City Council to pursue the funding necessary to finance the remainder of the project. On November 4, 2016 the applicant submitted an appeal request. Public Works recommends denial of this request.
