Agenda Item Summary:
The property owner of 1215 West Boulevard has applied for a demolition permit to demolish a detached garage, which is a contributing structure in the West Boulevard Historic District. They are also proposing to construct a new detached garage on the property. The applicant has stated that the existing garage is deteriorated and unsafe and cannot be repaired to meet current codes, supported by statements from a home inspector and contractor. Both the State Historic Preservation Office and the Rapid City Historic Preservation Commission have determined that the proposed project will encroach upon, damage, or destroy a historic property, however, it appears that there are no feasible and prudent alternatives to the proposal, and the proposal includes all possible planning to minimize harm to the historic resource. The HPC also made specific recommendations for the construction of the new detached garage. Rapid City Municipal Code Section 17.54.080.E.5.b requires that where the City has received a written determination of adverse effect by SHPO, the Director shall deny the project application. The applicant may appeal to the City Council within 10 calendar days. As such, the demolition permit application was denied, and the applicant requested the denial to be appealed to City Council. Pursuant to South Dakota Codified Law 1-19A-11.1, any project that is determined to cause adverse effect to historic property may not proceed until the City Council has made written determination, based upon the consideration of all relevant factors, that there is no feasible and prudent alternative to the proposal and that the proposal includes all possible planning to minimize harm to the historic property.
