Agenda Item Summary:
The applicant has submitted a Variance request to allow asphalt millings in lieu of hard surface and to allow a 6-foot fence in the front yard in lieu of 4 feet on the property located at 110 Rapid Street. The subject property is comprised of 0.48 acre, or 20,908 square feet, and is zoned General Commercial District (GC). The property currently contains a 6,400-square-foot commercial building. The applicant is proposing to demolish the existing building and utilize the property to park and store boats and trailers that are associated with the business, Black Hills Outdoors, whose principal place of business is located directly east of the subject property across 1st Street. A 6-foot tall chain link fence with opaque slats and a 20-foot wide lockable swing gate will be installed surrounding the property to screen the outdoor storage. Access to the property will be from 1st Street via a 24-foot-wide paved approach. Rapid City Municipal Code (RCMC) §17.50.270.G requires commercial off-street parking and equipment or vehicle maneuvering areas to be paved as set forth in the Minimum Standards for Construction of Parking Lots, June 16, 1980. The Minimum Standards for Construction of Parking Lots require either 4 inches of concrete, 4 inches of asphalt, or 2 inches of asphalt plus 4 inches of base course. Asphalt millings is not permitted as a hard surfacing material for parking or circulation unless a Variance is obtained. The applicant is requesting to allow the asphalt millings surface in lieu of pavement or concrete due to the intended use of the property as a secured storage lot with low traffic volume. Staff is recommending that a dust palliative be applied annually to the asphalt millings as required by RCMC §17.50.270.G.4. In addition, RCMC §17.50.340.C.1 states that no fence over 4 feet in height may be erected in any front yard within the commercial zoning districts. On double frontage lots, fences no more than 8 feet in height are permitted in the second front yard when set back a minimum of 10 feet from the property line. The subject property is a double frontage lot abutting 1st Street to the east and Rapid Street to the south. As such, the fence cannot exceed 4 feet in height along the street frontages unless a Variance is obtained. The applicant is proposing to install 6-foot tall chain link screening fence surrounding the entire property, including the property lines fronting Rapid Street and 1st Street, to provide increased security and allow for full usage of the property for parking and circulation. Staff is recommending that visibility be maintained through the proposed fence for 10 feet on each side of the gate and at the alley to preserve a pedestrian sight triangle as required by RCMC §17.50.335.H.
