Agenda Item Summary:
The applicant has submitted a Variance request to reduce the front yard setback from 35 feet to 19.7 feet for a shed. The subject property is located north of the intersection of Creek Drive and E. Saint Charles Street, is comprised of 1.42 acres of land zoned Flood Hazard District and is developed with two storage sheds. The existing asphalt pavement on Creek Drive needs to be replaced and as part of the City’s Capital Improvement Plan this street is being improved from E. Saint Patrick Street to the bridge over Rapid Creek (CIP No. 50549.24A). This project will include a new road base, geogrid, asphalt pavement and street markings. To facilitate the necessary street improvements, the City is proposing to acquire a portion of the subject property and widen the existing right-of-way. As per §17.50.250.C.8 of the Rapid City Municipal Code, accessory buildings in all zoning districts must be setback a minimum of 35 feet from the street right-of-way line. The northern storage shed on the property is set back approximately 23 feet from the current right-of-way line and is considered legal non-conforming. Once additional right-of-way is acquired the setback will be reduced to 19.7 feet, therefore necessitating this Variance.
