The applicant has submitted a Variance request to reduce the front yard setback from 25 feet to 0 feet, reduce the rear yard setback from 25 feet to 0 feet, reduce the side yard setback from 25 feet to 0 feet, and allow 100% lot coverage in lieu of 75% on the property located at 401 11th Street. The subject property is comprised of 0.72 acres and is zoned Light Industrial District (LI). The property currently contains the Cornerstone Thrift Store and associated donation receiving area, which is a valued community amenity that offers an assortment of donated clothing, furniture, household items, and other merchandise for purchase to patrons that may not otherwise be able to afford such goods. The applicant is proposing to place 5 Conex containers within the donation receiving area located on the north side of the property to serve as storage for donations and also as a security barrier. One Conex container will be located on the west property line and 3 Conex containers will be located on the north property line with each measuring 40 feet by 8 feet and 1 Conex container will be located on the east property line measuring 20 feet by 8 feet. All 5 Conex containers will be 9.5 feet in height. Opaque metal corrugated fencing and gates measuring 8 feet in height will be installed between the Conex containers with a matching color to fully enclose the donation receiving area. The existing chain link fence will be removed. The applicant has stated that the placement of the Conex containers supplemented with the metal fencing will enhance the aesthetic appeal of the property, improve the screening of the donation receiving area, and provide greater security. This approach is an improvement to the previous operation on the site and creates a visual buffer from the adjacent commercial area. The proposed layout is an efficient way to protect donations from the elements while providing security and screening. The applicant is also requesting to allow 100% lot coverage in lieu of 75% in order to bring the existing development on the property into compliance with the maximum lot coverage regulation of the Light Industrial District. The existing thrift store was constructed in 1949 per Department of Equalization records and the donation receiving area was recently paved per Grading Permit #CIBP24-2454 and serves as a loading/unloading facility for the thrift store. The coverage requirement in the Light Industrial District includes paved areas and, by this calculation, the existing development and site improvements on the property cover 100% of the lot area. The subject property was platted in 1992 with no interior lot line easements noted, so there are no easement impacts with this Variance request.
