Agenda Item Summary:
The applicant has submitted a Variance request to allow a detached garage with a maximum height of 20 feet in lieu of 15 feet on the property located at 305 N. 39th Street. The subject property is comprised of 3.74 acres and is zoned Low Density Residential District 1 (LDR-1). The property currently contains a structure that was formerly utilized as a Montessori school. The applicant is proposing to remove the existing structure and construct a new single-family dwelling with an attached garage and also a detached garage on the subject property. The new single-family dwelling will be 2,270 gross square feet with a 529-square-foot attached 2-stall garage. The proposed detached garage will measure 70 feet by 40 feet (2,800 square feet) in size with two 14-foot tall garage doors and will be used for personal storage of vehicles, a camper, and a UTV/ATV. Rapid City Municipal Code (RCMC) §17.10.060 states that an accessory building in the LDR-1 District cannot exceed 15 feet in height. The applicant is proposing to construct the detached garage with a height of 20 feet to allow for the 14-foot garage doors and clearance necessary for storing the camper and taller vehicles. The location of the proposed detached garage is recessed behind a steep hill that extends through the center of the subject property, which will provide screening to neighboring single-family dwellings. In addition, mature trees in the area also provide natural screening to adjacent properties. The abutting properties to the north and east with the most prominent view of the proposed detached garage are zoned General Commercial District where the maximum allowed height is 4 stories or 45 feet and are developed with existing commercial uses. Per RCMC §17.04.315, the building footprint of private garages, including any building, structure, or part of a main building that is dedicated to parking, storage, or a permitted accessory use, cannot exceed a cumulative size of 1,500 square feet or the footprint of the dwelling unit without the approval of a Conditional Use Permit. The footprint of the dwelling unit is proposed to be approximately 1,135 square feet with a 529-square-foot attached garage for a total footprint of 1,664 square feet. The detached garage area of 2,800 square feet exceeds the maximum 1,500 square feet of cumulative garage space and also exceeds the footprint of the dwelling unit by 1,136 square feet. In conjunction with this Variance request the applicant is requesting a Conditional Use Permit (File #25UR002) to allow an oversized garage
