The applicant has submitted a Conditional Use Permit to allow an oversized garage on the property located at 1301 E. Saint Charles Street in the Medium Density Residential District (MDR). The subject property is comprised of 0.24 acres, or 10,454 square feet, and currently contains a single-family dwelling. The applicant is proposing to construct a 24-foot by 41.7-foot (1,000-square-foot) detached garage on the subject property east of the single-family dwelling. The proposed detached garage will be constructed with 1 garage door on the north side of the structure facing E. Saint Charles Street and existing mature trees will provide a level of natural screening to the abutting properties to the east and south. The proposed garage must be constructed to match the materials and color scheme of the existing single-family dwelling and may not be used for commercial purposes or as a second residence. Historically, the Planning Commission has required that oversized garages be recessed behind the dwelling. The subject property is a corner lot with street frontage to both the north and west and the existing dwelling was constructed on the western side of the property in 1946. The siting of the existing dwelling and the dual-frontage precludes a location where the proposed detached garage could be recessed behind the dwelling. There is currently no garage located on the subject property. Per Rapid City Municipal Code (RCMC) §17.04.315, the building footprint of private garages, including any building, structure, or part of a main building that is dedicated to parking, storage, or a permitted accessory use, cannot exceed the footprint of the dwelling unit without the approval of a Conditional Use Permit in accordance with RCMC §17.12.030.A and §17.10.030.N. The footprint of the dwelling unit is approximately 662 square feet; therefore, the detached garage area of 1,000 square feet exceeds the footprint of the dwelling unit by 338 square feet and necessitates a Conditional Use Permit. The applicant has indicated that the oversized garage is proposed to be constructed 20 feet from the north front property line. RCMC §17.12.050.A.3 states that an accessory structure in the Medium Density Residential District accessed from a Local street must maintain a minimum 35-foot front yard setback. In conjunction with this Conditional Use Permit request the applicant is requesting a Variance (File #25VA010) to reduce the front yard setback from 35 feet to 20 feet for the detached garage.
