Agenda Item Summary:
The applicant has submitted a Conditional Use Permit to allow kenneling and an on-sale liquor establishment on the property located at 2512 Marlin Drive. The subject property is comprised of 3.78 acres and is currently undeveloped. The property is currently zoned General Commercial District (GC), which does not permit kennels. The applicant has submitted a Rezoning request (File #25RZ010) to zone a 2.64-acre portion of the property as Light Industrial (LI), which allows kennels as a conditional use, and will maintain a 1.14-acre portion as General Commercial District, which allows on-sale liquor establishments as a conditional use. The area zoned General Commercial District that will be used as an on-sale liquor establishment will be in the same building but physically separated from the area zoned Light Industrial District by a glass wall and controlled door to ensure that access to the kennel area is not granted to on-sale patrons with alcoholic beverages.The proposed building is approximately 11,587 square feet. Proposed uses include a dog and cat daycare and overnight kenneling facility, pet grooming, retail, photography services, and an on-sale liquor establishment with an outdoor patio that offers pour your own beer and social events. The facility will be open to the public between 6 a.m. to 7 p.m. daily with some social events and training sessions extending to 8 p.m. There will be 5 to 6 full-time staff members and 5 to 10 part-time staff members. The daycare will accommodate up to 90 dogs and the overnight kenneling will be limited to 50 dogs and 15 cats. It is expected that 45-60 pick-ups and drop-offs will occur during the hours of 7 a.m. to 9 a.m. and 4 p.m. to 6 p.m. and are scheduled in advance to take approximately 2 minutes at a time. A pet transport service van will also be provided as a pet transportation option. Based on the proposed operational plan, including staffing schedules, pick-up/drop-off schedules, and other services, the applicant has proposed 65 parking spaces. The on-sale area, retail, grooming, and storage uses require 30 parking spaces based on the proposed square footage associated with each use. The kennel use does not have a parking rate specified in the parking regulations and is based on the operational plan. Based on the operational plan, 35 additional spaces are required and the proposed parking is adequate. The applicant’s operational plan addresses noise and odor remediation, waste handling, traffic, equipment, vehicles, material storage, facility layout, services, and social activities. The noise associated with the kennel will be addressed by soundproofing material and physical barriers. Two playgroups of 15 dogs separated by size and temperament will be allowed outside at a time in separate fenced areas limited to the hours of 8 a.m. and 6 p.m. Training and screening for temperament will be conducted to manage issues with excessive barking, anxiety, or aggression and pets with issues will be turned away or isolated. Professional-grade artificial turf specifically designed for pet daycare and boarding will be installed to minimize odor, including drainage rock and sand that absorbs ammonia for outdoor areas.
