Agenda Item Summary:
The applicant has submitted a Rezoning request to change the zoning designation of the property at 3950 Fairway Hills Drive from Medium Density Residential District (MDR) to Office Commercial District (OC). The property is comprised of 1.35 acres and currently contains a 24-unit multi-family dwelling and an on-site management office. The applicant is proposing to discontinue the on-site management office and lease the building as a commercial office use. Throughout the community, the City is experiencing increased safety, security, and enforcement issues with multi-family dwelling developments that do not maintain an on-site management office. Eliminating on-site management for the multi-family building takes away an essential element of multi-family housing and alters the residential character of the property, traffic within the neighborhood, and could present a parking conflict with the tenants of the property. In addition, both Fairway Hills Drive and Byrnwood Drive are classified as Local streets and are not designed to accommodate commercial traffic. Though the Future Land Use designation of the property is Urban Neighborhood, which lists the Office Commercial District as a secondary zoning district, the Rezoning request constitutes spot zoning as there is only one other property presently zoned Office Commercial District within a half-mile of the subject property. In order to preserve the intent of multi-family residential development and the existing zoning and residential land uses in the surrounding area, Staff does not support the proposed Rezoning request.
