Agenda Item Summary:
The applicant has submitted a Rezoning request to change the zoning district of the vacant property currently addressed as 4924 5th Street from Office Commercial District (OC) to General Commercial District (GC). The property is located west of the intersection of 5th Street and Parkview Drive and is 1.26 acres in size. The lot shares an approach with the east adjacent property and the remaining frontage of the lot contains a non-access easement. The property abuts single-family homes to the rear and the subject property is approximately 20 feet lower in elevation than these homes. The purpose of the Office Commercial District is to provide a place for institutional and commercial activities and the purpose of the General Commercial District is to provide for personal and business services and general retail. The applicant has indicated in their letter of intent that the lot is planned to be developed with a four-unit retail building. Retail is not permitted in the Office Commercial District therefore necessitating the rezone. On August 1, 2005, City Council approved a Rezone request (File #05RZ043) to change the zoning district of the subject property from General Agriculture District to Office Commercial District in conjunction with a Planned Development Designation (File #05PD050). The Planned Development Designation requires the review and approval of the Planning Commission through a Final Planned Development Overlay prior to the issuance of a Building Permit or a Sign Permit on the property. The Planned Development process requires notification to area property owners which ensures they are informed of the future development plans for the property and have an opportunity to comment on that proposal.
