Agenda Item Summary:
The applicant has submitted a request for revocation of a Planned Development Overlay and a Planned Development Designation on the balance of Moon Meadows Park Subdivision totaling 11.14 acres. The properties are generally located northeast and southeast of the intersection of Mount Rushmore Road and Moon Meadows Drive and are zoned General Commercial District (GC). The existing Planned Development Designation (File #05PD090) was applied to the southwest portion of the subject properties when the area was rezoned from General Agricultural District to General Commercial District in 2006 (File #05RZ047). The Planned Development Overlay (File #05PD077) was applied to the northwest portion of the subject property in 2006 when it was the proposed location for construction of a Wal-Mart. The intent of the Planned Development Overlay and the Planned Development Designation was to ensure that the necessary site improvements and infrastructure for commercial development were provided as the area developed. The area has since been subdivided into several lots within the Moon Meadows Park Subdivision and the necessary street and utility improvements have been completed upon development of each lot. The applicant intends to subdivide the subject properties to be sold and developed separately as well. The applicant has stated that the anticipated uses of the properties will be consistent with those permitted in the underlying General Commercial District. If the Planned Development Overlay and Planned Development Designation are revoked, future development will not require the approval of a Final Planned Development Overlay. As part of a building permit review, the requirements of the General Commercial District must be met.
