Agenda Item Summary:
The applicant has submitted a Petition for Annexation for rights-of-way only, including Seger Drive rights-of-way lying outside the City limits in the SE1/4 of Section 19, 143rd Avenue rights-of-way lying outside the City limits in the S1/2 of Section 19, and 143rd Avenue rights-of-way adjacent to Lots 1 & 2 of Manley Subdivision in Section 20, all in T2N, R8E, BHM, Pennington County, South Dakota. The request includes a total of 5.67 acres of right-of-way to be annexed into the Rapid City municipal limits. This annexation request is being made in anticipation of the proposed Rapid City Destination District Tax Increment District (TID), which, if approved, will provide a funding mechanism for the creation of a multi-faceted visitor-oriented destination hub. Public improvements in these rights-of-way will be necessary as a part of this development, and the associated rights-of-way must be located within City limits to include these improvement costs as a part of the TID. A Planned Unit Development called “Rapid City Destination District” was approved by the City Council in December of 2022 (#22PD031) to encompass 302.1 acres, including 3 activity zones with specific land area regulations for each zone. These zones include a Resort Village Zone, a Commercial and Entertainment Zone, and an RV Resort Zone to be known as Libertyland. The portions of Seger Drive and 143rd Avenue located in the proposed annexation area are currently maintained by Rapid City, as identified through Road Agreement #RC 2023-1 with Pennington County. This proposed annexation is in alignment with the minimum requirements set forth in in South Dakota Codified Law and local ordinances and policies.
