Agenda Item Summary:
The applicant has submitted a Rezoning request to change the zoning district on a portion of an unplatted balanced located east of Haines Avenue and south of Country Road from Medium Density Residential District to General Commercial District. The unplatted balance is 66.32 acres in size and the portion proposed to be rezoned is undeveloped and 5.06 acres in size. A Preliminary Subdivision Plan (File #24PL115) has been submitted in conjunction with this request. The area proposed to be rezoned will be platted into a commercial lot, which is shown as proposed Lot 1 of Block 2 of Wazyata Subdivision. The applicant has indicated that the proposed lot will be developed with a mixed-use building with commercial on the ground floor and multi-family dwellings above, which is not permitted within the current zoning district. The proposed Rezone is necessary to implement the Initial Planned Development Overlay for the North Rapid Indigenous School and Community (File #22PD013), which was approved by the Planning Commission on April 21, 2022. The Initial Planned Development Overlay allowed the Master/Phasing Plan which included a school centrally on the property, commercial development along Haines Avenue and residential development on the northern and southern portions. The proposal is generally consistent with the previously approved Master/Phasing Plan. On October 27, 2022 the Planning Commission approved a Final Planned Development Overlay (File #22PD048) to allow three temporary school buildings and a parking lot on another portion of the unplatted balance to the northeast of the proposed Rezone adjacent to Country Road.
