The applicant has submitted a Variance request to reduce the east side yard setback from 8 feet to 6 feet for an addition onto the existing single-family dwelling located at 4205 Brookside Drive. The subject property is comprised of 0.21 acres and is zoned Low Density Residential District 1 (LDR-1). The property currently contains a single-family dwelling and a detached shed. The existing single-family dwelling was constructed in 1962 per Department of Equalization records with a 6-foot side yard setback on the east side, which does not meet the minimum side yard setback requirement for the LDR-1 District. However, based on the year of construction, the single-family dwelling as it currently exists is legal non-conforming with regard to setbacks. The applicant is proposing to construct an 8-foot by 28-foot (224-square-foot) addition onto the residence, which will be a continuation of the existing setback encroachment. The applicant has indicated that the proposed addition will allow adequate space to provide in-home care for her mother who has moved into the residence. The location of the proposed addition allows for the expansion of an existing bedroom and living area to provide the necessary accommodations. Per Rapid City Municipal Code ยง17.52.020, a legal non-conforming structure cannot be enlarged or added to unless it conforms with all requirements of the zoning district or a Variance is obtained.
