Agenda Item Summary:
The applicant has submitted a Variance request to reduce the rear yard setback from 5 feet to 0 feet for a shed on the property located at 103 East Saint Charles Street. The subject property is comprised of 0.26 acres and is zoned Medium Density Residential District (MDR). The property currently contains a single-family dwelling, a detached garage, and a detached shed. The existing shed measures 10-feet by 20-feet (200 square feet) and was built in 1965 per Department of Equalization records. The existing shed is located zero feet from the east property line on a concrete slab and does not meet the minimum rear yard setback requirement for the MDR District. However, based on the year of construction, the existing shed is legal non-conforming with regard to setbacks. The applicant is proposing to remove the existing shed and replace it with a new shed measuring 12-feet by 24-feet (288 square feet) utilizing the existing concrete slab. Per Rapid City Municipal Code ยง17.52.020, the legal non-conforming shed cannot be enlarged or replaced unless in conformance with all requirements of the zoning district or a Variance is obtained.
