The applicant has submitted a Variance request to reduce the side yard setback for a deck from two feet to one foot. The property consists of 7,000 square feet of land zoned Medium Density Residential District and is developed with a walk-out single-family dwelling built in 1948. The applicant is proposing to construct an uncovered deck that will be approximately 380 square feet in size. The proposed deck will be constructed along the east sidewall of the dwelling and will wrap around the rear wall above the walk-out. The deck will be built off the main floor and will access the side entrance door on the east sidewall. A new back door is being proposed on the south wall which will access the deck from the rear of the dwelling. The deck will have steps that will extend north along the side yard and another set of steps that will extend south into the rear yard. The home is set back approximately 4 feet from the side property line and the deck will be built approximately 7.5 feet from the neighboring home to the east. The side entrance of the home is currently accessed by small landings and steps that encroach onto the east adjacent property. The existing access to the side entrance is located within an Encroachment Easement. The proposed deck will provide a new accessway to this entrance thereby eliminating the need for the easement. As noted by the applicant, the construction of the deck will begin the process of removing the easement and returning the land to the property owner. As per ยง17.50.250.A.11 of the Rapid City Municipal Code, decks can be built a maximum of six feet into a required side yard setback. The setback requirement for a one-story dwelling is eight feet and therefore the minimum setback for a deck is two feet. This request is a one-foot deviation from that requirement.
