The applicant has submitted a Major Amendment to a Conditional Use Permit to expand on-sale liquor on the property located at 713 Seventh Street in the Central Business District (CB). The property is comprised of 0.98 acres and currently contains the Dahl Arts Center. The Dahl Arts Center has served as a regional arts center for contemporary visual arts, arts education, and performing arts since it opened in October 1974. It is a City-owned public facility that was gifted to Rapid City by Mr. & Mrs. A.E. Dahl and is managed by the Rapid City Arts Council. This multi-purpose community arts center is used by artists and arts organizations for events, and can be rented out for private and corporate gatherings. On-sale liquor in conjunction with an arts center was approved by the Planning Commission via Conditional Use Permit #09UR009 in 2009. The Conditional Use Permit only applied to events within the interior areas of the Dahl Arts Center as exterior spaces were not identified as part of the operations plan or site plan. The applicant is proposing to expand the existing on-sale liquor use into a proposed pocket park located on the property. The other elements of the existing operations plan are not proposed to change, such as only serving during events, hours of operation, handling, and storage; only the size and location of the area where on-sale liquor will be served is proposed to expand into the proposed pocket park area. The fenced-in portion of the pocket park is approximately 3,000 square feet in size. The applicant currently provides beer and wine for on-premises consumption at events that are typically in the evening and may last until up to midnight. All staff that handle alcohol complete a State-approved alcohol server training. The alcohol service is provided from temporary bars in the event space and the alcohol is stored in a locked storage unit within a secured employee-only catering kitchen when not in use. The same protocols will be applied in the proposed pocket park. The proposed pocket park will be located in an existing lawn area on the south side of the building adjacent to Quincy Street. The conceptual plan for the park includes landscaping, hardscaping, a 6-foot high decorative fence with controlled access, and a fabric shade structure. Proposed programming elements include an assembly area, outdoor sculpture collection, presentation stage, and projection screen. The primary public entrance will provide access from the gallery lobby. The pocket park in conjunction with other interior improvements is expected to lead to a 25% increase in visitation and up to 50 additional special events per year.
