Agenda Item Summary:
The applicant has submitted a Variance request to reduce the side yard setback to 8.5 feet in lieu of 12 feet for a single family residence that was wrongfully located on site. The subject property is comprised of 0.15 acres of land zoned Medium Density Residential. The site consists of a single-family residence with a footprint of approximately 1,358 square feet. The residence has recently been constructed and later determined that a small portion of the structure is within the minimum required 12-foot side yard setback. As stipulated in Chapter17.12.050 of the Rapid City Municipal Code, two story residential structures are required to be setback 12 feet from the side yard property line within the Medium Density Residential district. Therefore, a Variance application is required for the incorrectly located residential structure.
