Agenda Item Summary:
The applicant has submitted a Variance request to reduce front yard setback to 8 feet in lieu of 35 feet to build an 8-foot and 6-inch tall pergola within the front yard setback. Also, the applicant has submiited a Variance request to allow a 6-foot high wall in the front yard setback in lieu of the 4-foot maximum. The subject property is comprised of 11.2 acres of land zoned Park Forest District. The site consists of a single-family residence with a footprint of approximately 4,660 square feet. A proposed 8-foot 6-inch tall pergola is being located at the northeastern corner of the existing driveway. The proposed pergola will be located 8-feet from the front yard property line and encroach the required 35-foot accessory structure front yard setback by 27-feet. A proposed 6-foot tall gabion wall will be located directly north of the residence while spanning 160-feet along the property line, parallel with Skyline Drive. As stipulated in the Ordinance, accessory structures are required to be setback 35-feet from the front yard property line and walls within the front yard setback cannot exceed 4-feet in height. Therefore, a Variance application is required for the two proposals.

Staff recommends that if the Zoning Board of Adjustment determines that the proposed pergola and 6-foot tall wall is appropriate at this location, then the Variance to reduce the front yard setback to 8 feet in lieu of 35 feet for an accessory structure and to allow a 6-foot high wall in the front yard setback in lieu of the 4-foot height maximum shall be approved due to special circumstances surrounding the property. --------------------------------------Zoning Board of Adjustment Continued the Variance to the May 25, 2023 ZBOA Meeting: 5/4/2023; Zoning Board of Adjustment Approved the Setback Reduction to 8 feet based on Criteria #1 and 4: 5/25/2023 and Zoning Board of Adjustment Denied a rock wall ranging in height from 4.6 foot to 6 foot based on Criteria 1, 3 and 5: 5/25/2023 (3-4)
